An Overview of Steroids Offenses
Anabolic steroids and other performance-enhancing drugs have become big news and targets of prosecutions both federally and at the state level. Additionally, anti-aging clinics, and the health professionals that staff them, have been targeted for prosecution for the unlawful distribution of these substances. Many of the private citizens arrested for steroid possession and trafficking are normal, everyday people like you and ethical healthcare professionals writing and filling valid medical prescriptions.
If you find yourself the target of a steroid and/or HGh investigation and/or prosecution it is imperative that you obtain legal representation from a criminal defense attorney with extensive experience handling these types of cases.
Am I in danger of being arrested for a steroid crime?
Many arrests for steroid crimes occur when someone attempts to sell a steroid or other controlled substance to a person who turns out to be cooperating with the police.
Ordering steroids over the Internet is also an easy target for law enforcement. Many people have been arrested as a result of U.S. Customs or postal authorities intercepting steroida delivered by mail.
Steroid Cases are Not Like Other Drug Cases
Performance enhancing drugs and anabolic/androgenic steroids are not like street drugs, and many of them can be obtained and used legally. Many different substances fall under the label of “performance enhancing drugs” and will be associated with these cases.
Federal steroid charges can be complex and confusing, involving multiple defendants in multiple positions—all who are accused of multiple charges. Conspiracy indictments can include everyone from label manufacturers, peptide companies, owners of underground labs, board operators/moderators, vial and stopper suppliers, remailers, pharmacies, medical doctors, anti-aging clinics, and more.
The Successful Defense of A Steroid Case
Because the issues attendant to steroid cases are unique from other types of drug cases, it is imperative that an attorney be uniquely familiar with the legal and medical issues surrounding steroid matters. Steroid cases are not just drug cases! These cases often relate to prescriptions issued by medical doctors and/or individuals with legitimate medical concerns. Ms. Kudman has successfully defended steroid cases utilizing her unique understanding of these issues.
Ms. Kudman has successfully defended steroid cases. Indeed, in United States v. Del Toro (S.D.FL, 2014), Tama Beth Kudman obtained a full acquittal for a pharmacist charged in federal court with 38 counts of unlawfully distributing Anabolic Steroids, HGh, and Oxycodone. After a three-month long trial, the jury found the Defendant not guilty on each and every count.
Defending Medical Professionals
Ms. Kudman proudly defends doctors, pharmacists and all other medical professionals in regard to allegations of improper prescribing and dispensing of scheduled substances including: steroids, HGh, oxycontin, Xanax and other scheduled medications. With a deep understanding of the issues surrounding the practice of medicine, including evolving standards of care, the practice of telemedicine, off-label use of medications, and the use of physician extenders, Ms. Kudman has a unique ability to communicate with prosecutors and juries regarding the propriety of her client’s conduct. It was by using this knowledge that she obtained a full acquittal for a pharmacist charged in federal court with 38 counts of unlawfully distributing Anabolic Steroids, HGh, and Oxycodone.
Punishment can depend on various factors in either State or Federal Court, including the amounts of drugs involved and the jurisdiction of your case.
The Federal Anabolic Steroid Control Acts of 1990, expanded in 2004, classifies steroids as a Schedule III substance under federal law. Other Schedule III’s include barbiturates, LSD precursors, veterinary tranquilizers, and narcotic painkillers. Classification of performance enhancing drugs in that manner means a mere possession charge is a federal offense, making just a first offense punishable by up to one year in prison and/or a minimum fine of $1,000. That sentence is influenced by such factors as the defendant’s past criminal history, the strength of the case against him, his role in the charged conduct, and how effectively the case is either litigated or negotiated by defense counsel.
A steroid charge has the potential to ruin your life, despite the fact that steroids are significantly different in many ways from the other substances they have been categorized with under the law. There are medical, moral and social differences, in addition to chemical ones. All attorneys do not understand those differences, much less know to point them out and utilize them successfully in criminal cases.
